1. Acceptance of These Terms
These Terms of Use, referred to as the “Terms,” govern your access to and use of the Curriva Publishing public website, currivapublishing.com, and public-facing features that link to these Terms. By accessing or using the website, you agree to these Terms. If you do not agree, do not use the website.
“Curriva,” “we,” “us,” and “our” refer to Curriva Publishing, LLC. “You” refers to the person accessing the website and, when applicable, the organization on whose behalf that person acts.
2. Website Scope and Additional Agreements
These Terms govern the public website. Separate written agreements may govern textbook purchases, digital access, institutional licenses, author relationships, peer review, editorial services, learning management system integrations, authenticated accounts, the Curriva AI Concierge, or other Curriva products and services.
If a separate written agreement conflicts with these Terms, the separate agreement controls for the subject matter it covers.
3. Eligibility and Accounts
You must be legally capable of agreeing to these Terms or be authorized to act on behalf of an organization that agrees to them. The public website is intended primarily for educators, authors, institutions, professionals, and adult visitors.
The website may display a login interface for future services. As of the effective date, the public login is not connected to an active authentication system. When accounts become available, you will be responsible for providing accurate information, maintaining the confidentiality of your credentials, using reasonable security practices, and promptly notifying Curriva of suspected unauthorized access.
You may not share credentials, impersonate another person, access another user’s account, or attempt to bypass access controls.
4. Acceptable Use
You may use the website for lawful informational, educational, publishing, adoption, partnership, and business purposes consistent with these Terms. You may not:
- Use the website in violation of law, regulation, contract, or the rights of another person.
- Attempt to gain unauthorized access to the website, accounts, servers, systems, or data.
- Interfere with the availability, security, integrity, or operation of the website.
- Introduce malware, harmful code, automated attacks, or unreasonable traffic.
- Scrape, crawl, harvest, extract, index, or systematically download content except as authorized in writing or permitted by law.
- Use website content, publications, curriculum materials, or data to train, fine-tune, evaluate, or build an artificial intelligence or machine-learning system without written permission, except where such use is expressly permitted by law or a separate license.
- Copy, redistribute, sell, sublicense, publicly display, or create derivative works from Curriva content except as authorized by a license, written permission, or applicable law.
- Misrepresent your identity, affiliation, qualifications, or authority.
- Use the website to transmit unlawful, infringing, deceptive, abusive, discriminatory, threatening, or harmful material.
5. Intellectual Property and Licenses
The website and its original content, design, text, graphics, logos, trademarks, images, demonstrations, downloadable materials, and other elements are owned by or licensed to Curriva and are protected by intellectual-property laws.
Subject to these Terms, Curriva grants you a limited, revocable, nonexclusive, nontransferable license to access and use the public website for your own lawful informational or professional purposes. This license does not transfer ownership or authorize commercial exploitation, republication, redistribution, or use of protected materials outside the scope of an applicable license.
Curriva Publishing, the Curriva name, the Curriva medallion and torch design, and related branding may not be used in a way that suggests sponsorship, endorsement, affiliation, or authorization without written permission.
For information about classroom use, excerpts, accessible formats, reprints, translations, media use, or other permissions, review the Copyright & Permissions page.
6. Educational and AI Content
Curriva develops educational materials intended to support learning and instruction. Website content and demonstrations are provided for general informational and educational purposes and are not legal, financial, medical, accounting, tax, investment, or other professional advice.
When AI-supported features become available, outputs may be incomplete, inaccurate, outdated, or inappropriate for a particular context. Users remain responsible for exercising independent judgment, consulting assigned course materials and authoritative sources, following instructor and institutional policies, and verifying information before relying on it.
AI-supported features are not a substitute for student thinking, instructor judgment, professional advice, or emergency services. Users may not use Curriva services to misrepresent authorship, evade academic requirements, violate academic-integrity rules, or make prohibited high-stakes decisions.
7. Proposals and Other Submissions
Curriva welcomes inquiries and may invite proposals, manuscripts, sample chapters, curriculum materials, reviews, feedback, or other submissions. Unless Curriva has signed a separate confidentiality agreement, do not submit trade secrets, highly sensitive personal information, or material you are not authorized to disclose.
Submission does not create an author-publisher relationship, editorial relationship, agency relationship, employment relationship, fiduciary duty, obligation to review, obligation to publish, or guarantee of confidentiality. Curriva may already be considering or developing material that is similar in topic, concept, structure, or market focus.
You retain ownership of original material you submit unless a separate written agreement states otherwise. You represent that you have the rights necessary to submit the material and authorize Curriva to review, copy internally, share with appropriate editors, reviewers, advisors, contractors, or professional service providers, and otherwise process the material for evaluation and communication purposes.
Feedback or suggestions about the public website may be used by Curriva without obligation, provided that Curriva will not claim ownership of your preexisting copyrighted work merely because you submitted feedback.
8. Third-Party Services and Links
The website may contain links to or integrations with third-party websites, learning systems, payment tools, hosting services, social platforms, or other resources. Curriva does not control and is not responsible for third-party content, availability, security, privacy practices, or terms. Your use of third-party services is governed by their own agreements.
9. Disclaimers
To the fullest extent permitted by law, the public website is provided on an “as is” and “as available” basis. Curriva does not warrant that the website will be uninterrupted, error-free, secure, complete, current, or suitable for every purpose.
Curriva may update, correct, remove, or change website content, product descriptions, publication plans, pricing, availability, features, or services at any time. Website information does not constitute a binding offer unless expressly stated in a separate written agreement.
Some jurisdictions do not allow certain warranty disclaimers, so portions of this section may not apply to you.
10. Limitation of Liability
To the fullest extent permitted by law, Curriva and its owners, officers, employees, authors, editors, reviewers, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, business opportunities, goodwill, or educational outcomes arising from or related to the public website.
To the fullest extent permitted by law, Curriva’s total liability for claims arising from the public website will not exceed the greater of the amount you paid Curriva specifically for the public website service giving rise to the claim during the twelve months before the claim or one hundred U.S. dollars.
Some jurisdictions do not allow certain limitations of liability, so portions of this section may not apply to you.
11. Responsibility for Your Conduct
You are responsible for your use of the website, the information you submit, and your compliance with applicable law, institutional policies, and third-party rights. To the extent permitted by law, you agree to reimburse Curriva for reasonable losses, liabilities, costs, and expenses arising from your unlawful use of the website, your infringement of another person’s rights, or your material violation of these Terms.
12. Suspension and Termination
Curriva may suspend, restrict, or terminate access to website features when reasonably necessary to protect the website, users, Curriva, service providers, or the public; investigate suspected misuse; comply with law; or enforce these Terms. Provisions that by their nature should survive termination will continue to apply.
13. Governing Law
These Terms are governed by the laws of the State of Kansas and applicable federal law, without regard to conflict-of-law principles. Any dispute not governed by a separate written agreement will be brought in a court of competent jurisdiction located in Kansas, unless applicable law requires otherwise.
Nothing in these Terms limits rights that cannot lawfully be waived.
14. Changes to These Terms
Curriva may update these Terms as the website, products, services, and legal requirements evolve. We will post the revised Terms and update the “Last updated” date. Material changes may be accompanied by additional notice when appropriate. Your continued use of the website after updated Terms become effective constitutes acceptance to the extent permitted by law.
